Prevailing accounts of the relationship between rights and identity impose a false choice between conceptions of rights as the instrument of self-invention or the foil to collective virtue. This article proposes an alternative conception of rights as constitutive of social relations and aspects of individual identity. To do so, it draws on H. L. A. Hart's famous distinction between special and general rights, and it describes the exclusionary and inclusionary conditions under which these forms of right constitute social groups and (...) self-meaning. Further, it specifies a pure form of «constitutive right», overlooked in Hart's typology, but extant in modern liberal, pluralistic societies, that inherently differentiates among persons and so directly constitutes aspects of human identity. Quantum electrodynamics is the theory of electrons and other elementary charged particles, interacting through the exchange of light quanta. Albert Einstein introduced the light quantum in 1905, but for about three decades physicists applied quantum ideas mainly in theories of the structure and behavior of matter, not to electromagnetic radiation itself, which was always treated semi-classically. This began to change after 1923 with the discovery of the Compton effect and its kinematic description by Arthur Compton and Peter Debye, based on (...) the light quantum. In this paper we review the study of high-energy radiation that led to Compton's discovery. We discuss the analysis of the intensity distribution of Compton-scattered radiation that together with the ''new'' quantum theory beginning in 1925, resulted in the development, especially by Pascual Jordan and Paul Dirac, of a quantum theory of electromagnetic radiation in interaction with matter. I consider and reject four possible arguments directed against the preservation of natural aesthetic conditions. (1) Beauty is not out there in nature, but is “in the eye ofthe beholder.” I argue that since ingredients ofnature cause aesthetic experiences, we cannot justifiably disregard and exploit nature. Preservation of aesthetic conditions is compatible with both objective and nonobjective theories of aesthetic value. (2) Frequent aesthetic disagreements bring about irresolvable disputes concerning which segments of nature to preserve. I claim that these disputes (...) are not irresolvable. Not all disputes about nature’s aesthetic values are purely aesthetic disputes: ecological balance, community identity, historic continuity, and economics are relevant; aesthetic experts can help; and such disputes can be put to a vote. (3) Natural beauty is not important compared to nonaesthetic values of nature. I show that this is questionable. Current awareness of environmental problems includes a rapidly growing concern for natural aesthetics. Moreover, even if majority preference is for nonaesthetic uses of nature, this does not settle the question of whether we ought to preserve nature’s attractive features. (4) From neither a utilitarian nor a deontological viewpoint do we have an obligation to preserve natural aesthetic conditions for future generations. I argue that even if we do not have a strict obligation, it does not follow that it makes no moral difference whether we preserve. Not yet existing people may have no rights against us, but this does not mean that we do no wrong in polluting and destroying aesthetic conditions of the natural world in which future people will live. En 1965, il écrit deux préfaces consacrées à la danse, et la danse occupe une place importante dans le Vocabulaire d’esthétique qu’il dirige. Ces textes demandent à être replacés dans leur contexte institutionnel et théorique, ce qui nécessite de remonter jusqu’aux années 1920-1930. The word ‘existentialism’ has become something of a catchword in religious circles today, and one suspects that it is sometimes a substitute rather than a medium for thought. Most theological teachers must from time to time have received from a pupil an essay in which the words ‘existential’, ‘existentially’ and ‘existentialism’ appear to have been sprinkled from a pepper-pot over an exposition whose meaning would remain unchanged if these words were excised altogether. Nevertheless, usum non tollit abusus, and the following (...) rather unsystematic remarks may perhaps be of some help in elucidating and evaluating a mode of thought and expression which has attracted the interest of some of the more profound, as well as of some of the more superficial, theological and philosophical writers of the present day. We show that the first order theory of the lattice $\mathscr{L}^{ (S) of finite dimensional closed subsets of any nontrivial infinite dimensional Steinitz Exhange System S has logical complexity at least that of first order number theory and that the first order theory of the lattice L(S ∞ ) of computably enumerable closed subsets of any nontrivial infinite dimensional computable Steinitz Exchange System S ∞ has logical complexity exactly that of first order number theory. Thus, for example, the lattice of (...) finite dimensional subspaces of a standard copy of $\bigoplus_\omega$ Q interprets first order arithmetic and is therefore as complicated as possible. In particular, our results show that the first order theories of the lattice L(V ∞ ) of c.e. subspaces of a fully effective ℵ 0 -dimensional vector space V∞ and the lattice of c.e. algebraically closed subfields of a fully effective algebraically closed field F ∞ of countably infinite transcendence degree each have logical complexity that of first order number theory. Uncertainties about how to achieve sustainable and reliable biobased value chains can be remedied by inclusion of local biomass producers. Such inclusion implies that the knowledge, values, interests and skills of these local producers are integrated into the set-up, design, development and associated distribution of risk and benefits of the specific value chain. To make sure that this inclusion is both fair and effective, capabilities of relevant actors need to be taken into account, i.e. the capabilities of biomass producers and (...) of companies and local governments. Building on these capabilities can lead to context sensitive design of biorefineries that allow for true inclusion of local stakeholders. We support this claim with reference to the case of sugarcane production in Jamaica. (shrink)
